Terms of Service
1. Agreement
These Terms govern your use of carbsynq.com (the "Service") operated by CarbSynq GmbH (Friedrichstraße 191, Berlin 10115, Germany). By using the Service you accept these Terms. If you do not accept them, do not use the Service.
If you are a consumer (a natural person acting outside your trade, business, craft, or profession), nothing in these Terms limits your statutory consumer rights under your country of residence.
2. Use of the Service
- You must be at least 18 years old or have parental consent.
- You agree not to use the Service for unlawful purposes, to interfere with operation, or to attempt unauthorised access.
- You may not copy, scrape, or reverse-engineer the Service except as permitted by mandatory law.
3. Intellectual Property
The Service, including all content, is owned by CarbSynq GmbH or its licensors and is protected by EU and international intellectual-property law. You receive a limited, non-exclusive, non-transferable licence to use the Service for its intended purpose.
4. User Content
You are responsible for any content you submit. You represent that you have the necessary rights. You grant us a limited licence to use, store, and process the content to provide the Service.
5. Right of Withdrawal (Consumer Contracts)
Where you enter into a paid contract with us as a consumer at distance, you have the right to withdraw within 14 days under the EU Consumer Rights Directive without giving any reason. To exercise the right, contact us at [email protected] with a clear statement of withdrawal. We will refund all payments received within 14 days.
The Service as currently offered through carbsynq.com does not include direct paid digital content; this clause applies only if and when paid services are offered.
6. Disclaimers and Statutory Guarantees
The Service is provided on an "as is" basis. Nothing in these Terms excludes or limits our liability for (a) death or personal injury caused by negligence, (b) fraud or fraudulent misrepresentation, or (c) any other liability that cannot be excluded under mandatory law. Statutory guarantees that apply to consumers under EU law are not affected.
7. Limitation of Liability
To the extent permitted by law, CarbSynq GmbH's total liability for any claim arising from or related to the Service will not exceed EUR 100, except for liability that cannot be limited under mandatory law (see Section 6).
8. Termination
We may suspend or terminate your access for breach of these Terms. Sections that by their nature should survive termination will survive (Sections 3, 6, 7, 9, 10).
9. Governing Law and Jurisdiction
These Terms are governed by the laws of Germany.
The courts of Berlin, Germany have exclusive jurisdiction, subject to mandatory consumer-protection rules of your country of residence (Article 17-19 Regulation (EU) 1215/2012). If you are a consumer, you may also bring proceedings before the courts of your country of residence and we may sue you only in those courts.
The European Commission provides an Online Dispute Resolution platform at ec.europa.eu/consumers/odr. We do not commit to using ODR but will cooperate where required.
10. Changes
We may update these Terms. Material changes are posted with a new "Last updated" date.
